Summary of Terms and Conditions

• ‘TICA’ refers to the Thermal Insulation Contractor’s Association (TICA) of which ACAD is a division.
• ‘ACAD’ refers to the Asbestos Control and Abatement Division (ACAD).
• ‘Booking’ refers to any training course, qualification, or other event provided by ACAD or its sub-contractors acting on behalf of ACAD.
• ‘Booker’ refers to the individual or company representative responsible for completing the Booking Form to register candidate(s) for a Booking. The Booker received the Booking confirmation and is authorised to complete the Booking Form on behalf of the candidate(s) and/or their company. A company may have multiple bookers.
• ‘Booking Form’ refers to the official ACAD booking form or that completed through CourseSight.
• ‘Booking Fee’ refers to the cost associated with the Booking, which may include additional charges for external bodies related to candidate registration numbers, examination feed, and other relevant expenses.
• ‘Candidate(s)’ refers to the individual(s) attending the Booking.
• ‘VAT’ refers to the United Kingdon’s Value Added Tax.
• ‘Assessor(s)’ refers to the individual(s) authorised to assess candidate(s) on behalf of ACAD.

Bookings:
1. Booking Submission & Acceptance
A booking will not be accepted unless a fully completed Booking Form is submitted either via CourseSight or e-mail and has been acknowledged with a receipt.
2. Financial Responsibility
By completing and submitting the ACAD booking Form or completing the booking via CourseSight, the Booker confirms that either the company or, in the case of an individual booking, the individual assumes full responsibility for covering the cost of the Booking.
3. Purchase Order Requirements
Where a company requires the provision of a purchase order number, it is the Booker’s responsibility to ensure that the necessary details are provided at the time of booking.
4. Contract Formation
A Booking Form submitted to ACAD or a completed booking through CourseSight becomes valid when the Booker receives a formal Booking Confirmation via e-mail. At this point, a legally binding contract is formed between ACAD and the Booker.
5. CITB Grant Eligibility
If the Booker’s company is eligible for CITB grants for short-duration courses, all mandatory fields on the Booking Form must be completed. Failure to provide the required information will prevent ACAD from submitting the grant claim on behalf of the company. ACAD is not responsible for any CITB grant that the company fails to receive due to incomplete or missing information.

Booking confirmation and joining instructions:
ACAD shall issue comprehensive joining instructions to the Booker for the candidate(s) attending the Booking which will include details regarding the start time of the Booking. In the event that the Booker does not receive the joining instructions, it is their responsibility to contact ACAD via telephone 01325 466704 or email at training@acad.uk.com to request reissue of the instructions, no later than 48 hours prior to the commencement of the event.
For online Training Courses – it is the responsibility of the Booker and the Candidate(s) to ensure that they have received the link to the online Training Course provided in the joining instructions and have completed the registration process prior to the date of the training course. Candidates are required to log in at least 30 minutes before the commencement of the training course for registration and to address any potential IT issues.
Failure to attend the Booking due to non-receipt of joining instructions and subsequent failure to log in correctly will result in the full cost of the Booking being charged. It is the responsibility of the Booker to ensure that each Candidate is full briefed and made aware of these instructions and all Booking requirements prior to attending the Booking.
All information provided is given in good faith, and ACAD shall not be held liable for any actions taken by the Candidate(s), or any other individual or organisation, as a result of the information provided during the Booking.
Price:
All standard booking fees are listed on the ACAD booking website (CourseSight) and can be provided by the Training Administration team. ACAD reserves the right to change prices listed without notice. The cost of a bespoke training course will be confirmed by ACAD in writing.
Booking fees do not include travel, accommodation or any other costs incurred as a result of or in connection with a Booking.

Payment Terms:
For ACAD Members:
Candidate(s) will not be eligible to attend the Booking without providing a PO or full payment. ACAD reserve the right to withhold certificates until full payment has been cleared. Booking payments can be made in the following ways:
• Credit or Debit Card
• Direct bank transfer to the TICA bank account, details of which are available through the Training Administration Team.
For Non-Members:
Non-members of ACAD must make full payment at the time of booking. ACAD reserve the right to withhold certificates until full payment has been cleared. Booking payments can be made in the following ways:

Cancellations / Substitutions / Refunds
1. General Cancellation Terms:
• Cancellations must be made in writing and sent to ACAD via e-mail to training@acad.uk.com or by phone at 01325 466704
• Cancellations made more than 14 days prior to the commencement of the event will incur no penalty.
• Cancellations made within 14 days of commencement of the event will incur a cancellation fee of 25% (for ACAD Members) and 50% (for Non-Members) of the Booking Fee.
• Cancellations made within 7 days of the commencement of the event will incur a cancellation fee of 100% of the Booking Fee.
2. Rescheduling
• Request to reschedule a event must be made in writing and are subject to availability.
• Rescheduling requests more than 7 days prior to the commencement of the event will incur no penalty.
• Rescheduling made within 7 days of the commencement of the event will incur a cancellation fee of 100% of the Booking Fee.
3. Non-Attendance
• Failure to attend the Booking without prior notice will be treated as a cancellation and will incur a cancellation fee of 100% of the Booking Fee.
4. Exceptional Circumstances
• In the event of exceptional circumstances (e.g. illness, natural disasters), ACAD may, at its discretion, waive cancellation or rescheduling fees. Supporting documentation may be required.
5. ACAD Cancellations
• If ACAD needs to cancel a booking, a full refund will be provided, or an alternative date will be offered. ACAD will not be liable for any additional costs incurred by the Booker or Candidate(s) as a result of the cancellation.
ACAD reserves the right at any time to vary event dates, trainers/assessors and venues. ACAD will endeavour to inform the Booker as soon as possible of any event cancellation or variation.
Candidates:
The Booker agrees to indemnify ACAD for any loss, damage or injury caused to ACAD’s property, employees, or any third party by the conduct, act or omission of a Candidate.
Candidate(s) must attend and complete all aspects of the Booking(s) to qualify for certification. The full cost of the course will be charged for candidate(s) who arrive late or are absent from all or part of the course, even if refused admittance due to tardiness.
Candidate(s) must bring one form of original photographic identification, valid for at least 6 months. Candidate(s) must comply with all the rules, procedures, policies and guidelines in place at the Booking venue and/or ACAD premises. Failure to comply may result in the candidate(s) forfeiting the course and full payment being taken.
Candidate(s) are prohibited from bringing the following onto ACAD or any third-party premises:
• Alcohol / illegal substances.
• Any object that could be used to threaten or injure another person.
Candidate(s) may be required to leave the Booking and ACAD premises immediately if they are:
• Under the influence of alcohol or illegal substances.
• Possessing illegal substances.
• Misusing legal substances.
• Displaying threatening, abusive or inappropriate behaviour (including sexual harassment).
• Not adhering to TICA’s Equality and Diversity Policy.
• Unsuitably dressed.
• A risk to the health and well-being of themselves and/or others.
ACAD shall not be liable for any refund or compensation if a Candidate is required to leave for reasons within their control.
Meeting the needs of Candidate(s):
To ensure that all Candidate(s) are treated fairly and their requirements are met, the Booker must advise ACAD in advance of any special requirements. ACAD does not provide any specialist equipment or personnel such as signers or translators; these must be sourced at the Booker’s cost.
It is the employer's responsibility to ensure that Candidate(s) have the necessary physical, communication, literacy and numeracy skills required for the event. Employers must also ensure Candidate(s) are free from any condition affecting their capability to undertake the event, and have the aptitude for intensive study. Employers must ensure Candidates with disabilities are appropriately supported in their workplace.
ACAD welcomes advance notification of any assistance that a Candidate(s) may need during the event(s).

If a Candidate fails to meet the learning outcomes of the training course, they will require a Training Needs Analysis assessment. Additional training beyond that provided in the Booking may incur additional charges. Attendance does not imply or confer competency.
Additional Booking Requirements placed upon ACAD by
Additional requirements imposed by external Awarding Bodies will be stated in the scheme information and will be in conjunction with these Terms and Conditions.
Unforeseen Circumstances:
ACAD shall not be liable for any delay or consequences of delay in performing obligations due to causes beyond reasonable control, including strikes, system breakdowns, floods, fire, explosions or accidents.
Limitation of Liability:
Except for death or personal injury caused by ACAD’s negligence, ACAD shall not be liable for any loss of profit or indirect, special or consequential loss, costs, expenses or other claims for compensation. ACAD’s liability shall not exceed twice the contract value. This does not exclude liability for fraud.
Intellectual Property:
Each party confirms ownership or rights to use all intellectual property related to the services Intellectual Property remains with the originating party unless otherwise agreed in writing. Each party indemnifies the other against claims related to intellectual property ownership or use.

ACAD’s names, images and logos are proprietary marks. All content is protected by UK and international copyright laws.
You may not:
• Reproduce any part of the e-Learning content
• Modify or use the materials for any commercial purpose
• Share or distribute access to the e-Learning content
• Transfer the materials to another person

Technical Requirements for e-Learning:
Recommended devices: desktop computer, laptop, or standard-sized tablet (NOT SMARTPHONE). Minimum requirements:
• Operating system: Windows, Apple or Android
• Processor: 3 GHz
• RAM: 2 GB
• Broadband speed: 512 kbps
• Screen resolution: 1024 by 768
• Currrent version of Microsoft Edge, Safari, Chrome or Firefox, or Internet Explorer 11

All personal data provided will be processed and stored in accordance with ACAD’s GDPR policy
