TEC TRAINING (GB) LTD TERMS & CONDITIONS OF CONTRACT FOR TRAINING SERVICES

Jurisdiction
These Terms & Conditions of contract apply to any bookings made or for any course or event offered by Tec Training (GB) Ltd. In the event of any conflict between these Terms & Conditions and other Terms & Conditions, these Terms & Conditions shall prevail unless expressly agreed otherwise in writing by Tec Training (GB) Ltd. No variation can be made to these Terms & Conditions without prior written consent from Tec Training (GB) Ltd. These Terms & Conditions of contract shall be interpreted in accordance with English Law and the parties agree to submit to the jurisdiction of the country in which the courses/events are held.

Acceptance
These Terms & Conditions of contract are confirmed as accepted by the Client once the Client has completed and signed this document OR a Course Booking Form.

Course Bookings
When booking courses or events, Client purchase order numbers must be quoted on the Tec Training (GB) Ltd Course Booking Form or a Client Order Form must be submitted at the time of booking. For all Track Safety Courses, the Course Booking Form must be signed by your (Sponsor) Company Sentinel Administrator.

Cancellation and Transfer of Bookings
Where clients cancel courses with less than 14 days notice, the course fee is payable in full. If you have made a booking within 14 days from the course start date you will not be eligible for any refunds. Substitution of a nominated delegate can be made free of charge up to 48 hours prior to the event-taking place. Tec Training (GB) Ltd will endeavour to run all advertised and programmed events. However due to unforeseen circumstances it may be necessary to reschedule or cancel a particular event. In such cases Tec Training (GB) Ltd will not accept any consequential liability irrespective of notice given.

Indemnity
The client shall indemnify and hold harmless Tec Training (GB) Ltd for any claim resulting from injury to persons and damage to third party property except as a direct result of the negligence of Tec Training (GB) Ltd or its employees. Tec Training (GB) Ltd shall not be liable for any financial, economic or consequential losses of any kind that may be incurred by the client either directly or indirectly in the performance of the contract.

Payment
For account clients, payment for courses/events must be made within 28 days of the date of an invoice. If we cannot obtain credit clearance for a customer, course fees will be payable in advance. All fees are exclusive of VAT. Individuals funding for the courses for them self’s will need to clear payment before any training course commences. Details on how to make payments can be gained by contacting the Accounts Department at Tec Training (GB) Ltd.

Certification and Course allocation
Please note we are not liable for any lost certificates/documents due to the postal service. Additional charges may apply to re-order certificates/documents.Once you have been allocated a course date you will not be eligible for a refund. Should you fail to attend on time on your allocated course date, you will not be permitted onto the course and full fee will be applied.

Zero Tolerance
Use of profanity, verbal threats or any act of violence will NOT be tolerated.

Railway Courses
Please note for Railway Courses: Delegate places are not confirmed and Joining Instructions will not be issued until we have received the completed signed booking form from the sponsor with purchase order details or credit/debit card payment have been taken. Please allow 48 hours for bookings to be processed. Our booking system works on a first come first served basis; we do not reserve or hold places. The training team process bookings and queries Monday to Friday from 10:30 to 15:00.

PTS Medical Requirements & E-learning
It is a course requirement that all delegates meet the minimum Network Rail medical fitness standard laid down in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements) and alcohol and drug screening as required in specification GE/RT8070 Issue 2 (Testing Railway Safety Critical Workers for Drugs & Alcohol). The client must provide Tec Training (GB) Ltd with evidence of this prior to the course in the form of the original medical certificate or a copy endorsed in ink as a ‘true copy’ by the employer. This applies only to PTS Initial training. It is a course requirement that all delegates have completed the necessary E-learning module prior to attending any rail course. We reserve the right to refuse acceptance of the delegate onto the course or to allow the delegate to complete the course if delegates fail to complete the E-learning module. In such cases, the full course fee remains payable.

Medical Requirements – All courses undertaken
It is a course requirement that all delegates meet the minimum Network Rail medical fitness standard in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements and alcohol and drug screening to GE/RT8070 Issue 2 (Drugs and Alcohol) must be met prior to the course. Please note that a Network Rail approved provider must perform medical examinations. If you require a Medical and D&A test please contact our sales team.

Personal Identification
Delegates attending any course must produce photo ID in the form of Passport, international ID card, accompanied with Right to Work in the UK unless specified otherwise.

Late arrivals/missed sessions
If a delegate arrives late for a course/event or is absent from any course/event sessions, we reserve the right to refuse acceptance of the delegate onto the course or to allow the delegate to complete the course. In such cases, the full course fee remains payable.

Unauthorised Recording
We do not authorise any use of recordings or cameras during exams and training. If you are found in possession of any recordings/pictures once entered into the centre you are breaching our terms of business and will be deemed liable for prosecution. Any recordings or pictures taken will be deemed as the property of Tec Training (GB) Ltd. 24-hour CCTV surveillance in operation

CCTV Surveillance
For your personal safety and security, video linked security cameras maintain constant recorded surveillance of the premises. Video evidence can be used in a court of law. All activities are recorded to aid in the prosecution of any crime committed against the facility.

Working Hours
All delegates attending any training event must ensure that they have not worked 123 hours prior to the training event in line with NR/L2/ERG/003
