Seaton Rail Ltd - Terms and Conditions

JURISDICTION

These terms and conditions of business apply to any bookings made or for any course or event offered by Seaton Rail Limited.

In the event of any conflict between these terms and conditions and other terms and conditions, these terms and conditions shall prevail unless expressly agreed otherwise in writing by Seaton Rail Limited. No variation can be made to these terms and conditions without prior written consent from Seaton Rail Limited.

These terms and conditions of business shall be interpreted in accordance with English Law and the parties agree to submit to the jurisdiction of the country in which the courses/events are held.

2. ACCEPTANCE

These Terms and Conditions of business are confirmed as accepted by the Customer once the Customer has completed and signed the booking form, or signed a specific contract between the parties.

3. COURSE BOOKINGS

When booking courses or events, Client purchase order numbers must be quoted on the Seaton Rail Limited. Course Booking Form or a Customer Order Form must be submitted at the time of booking. For all Track Safety Courses, the Booking Form must be signed by your Company Sentinel Co-ordinator.

4. CANCELLATION AND TRANSFER OF BOOKINGS

Where Customers cancel courses with less than 14 days’ notice, the course fee is payable in full.

Substitution of a nominated delegate can be made free of charge up to 24 hours prior to the event taking place.

Seaton Rail Limited will endeavour to run all advertised and programmed events. However due to unforeseen circumstances it may be necessary to reschedule or cancel a particular event. In such cases Seaton Rail Limited will not accept any consequential liability irrespective of notice given.

5. INDEMNITY

The customer shall indemnify and hold harmless Seaton Rail Limited for any claim resulting from injury to persons and damage to third party property except as a direct result of the negligence of Seaton Rail Limited or its employees. Seaton Rail Limited shall not be liable for any financial, economic or consequential losses of any kind that may be incurred by the customer either directly or indirectly in the performance of the contract.

6. PAYMENT

Payment for courses/events must be made within 30 days.

Note all fees are exclusive of VAT.

7. MEDICAL REQUIREMENTS – PTS

It is a course requirement that all candidates meet the minimum Network Rail medical fitness standard laid down in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements) and alcohol and drug screening as required in specification GE/RT8070 Issue 2 (Testing Railway Safety Critical Workers for Drugs & Alcohol).

The customer must provide Seaton Rail Limited with evidence of this prior to the course in the form of the original medical certificate or a copy endorsed in ink as a ‘true copy’ by the employer. This applies only to PTS Initial training.

8. MEDICAL REQUIREMENTS – IWA, COSS, LOOKOUT, HANDSIGNALLER, PC, ES

It is a course requirement that all candidates meet the minimum Network Rail medical fitness standard in NR/L2/OHS/00124 (Competence Specific Medical Fitness Requirements and alcohol and drug screening to GE/RT8070 Issue 2 (Drugs and Alcohol) must be met prior to the course.

Please note that medical examinations must be performed by a Network Rail approved provider.

9. PERSONAL IDENTIFICATION

Course delegates attending an initial PTS must produce photo ID in the form of Company ID, Passport or new style Driving Licence. All delegates on other courses must produce their Sentinel Track Safety Cards.
